Language Obligations in Insurance, in Quebec and Canada

An insurance contract is a contract of adhesion: its French version must be provided to the insured before they can opt for English. What that changes for insurers and brokers.

In Quebec, an insurance contract is a contract of adhesion: the insured must have received the French version before being able to accept an English one. A waiver holds only if the choice was real. In practice, the insurer must therefore have the French version at the point of sale, not afterwards.

What happens if you fall short

The exposure goes beyond formal compliance. An ambiguous clause in a contract of adhesion is read in the adherent's favour: if the French version of an exclusion is narrower than the English, the reading favourable to the insured is the one likely to prevail. A loose translation therefore does not merely create a regulatory breach — it widens the coverage you thought you had drawn.

Can the insured simply ask for English?

Yes, but after having had the French version in front of them. A box ticked early in the journey, before any French version exists, is not the choice the law contemplates.

Do claim documents have to be translated?

Those handed to the insured, yes — particularly a denial decision, which must be understood by its recipient. Internal handling documentation follows a different logic.

How do we stop an exclusion diverging between versions?

By translating recurring clauses once, having them approved, then locking them: no translator can afterwards reword an exclusion that has been signed off.

We sell into Quebec from Ontario. Are we covered?

The obligation follows the customer, not the head office. A product offered to a Quebec consumer falls under Quebec requirements, whatever province it is sold from.
